Insurance Law & Bad Faith — California, like most other states, requires that when an insurance company receives a notice of a claim from one of their insureds, they take the time to investigate the claim quickly and make a determination of benefits based on that investigation. They cannot process a claim based on some internal policy of just denying everything that comes in. When an insurance company refuses to investigate or pay a legitimate claim, it is called "bad faith." The law provides stiff penalties for bad faith.
