Holding Life Insurance Companies Accountable

If you have lost a loved one, you may be relying on his or her life insurance policy to meet your financial needs during this period of grief and loss. If the insurance company is refusing to pay out on that policy, you need a legal advocate who is prepared to stand up for your rights.

At The Law Offices of Hiepler & Hiepler, our life insurance denial lawyers help clients in California and beyond pursue claims against life insurance companies that have denied their claims. Our attorneys are committed to helping our clients get the results they deserve.

Verdicts And Settlements

  • $2 Million — Life insurance payment denial — delay — Los Angeles Superior Court

We have achieved record-setting verdicts and settlements in a variety of insurance and HMO claim denial, as well as personal injury, cases. This includes an $89.3 million jury verdict in the Riverside Superior Court for bad faith insurance practices.

Is Your Insurer Refusing To Pay?

Any time someone dies within a few years of taking out a substantial life insurance policy, the insurance company is going to be suspicious. This is understandable. However, that does not mean the company can deny a claim that it is required to pay under the insurance contract.

Almost all life insurance contracts contain a noncontestability clause specifying that the insurance company cannot rescind the policy or contest a claim after the first two years.

Unfortunately, insurance companies often try to get around noncontestability by delaying the effective date of the policy so they can claim that the application was fraudulent, that the applicant failed to disclose something or that the applicant died from a pre-existing condition.

This approach is known as post-claims underwriting, and it is an unethical practice that is very often in breach of the insurance contract. Our attorneys are prepared to take your insurance company to court, if necessary, to stop them from canceling your policy or denying your claim.
